1. Agreement
These Terms of Use ("Terms") govern your access to and use of the Coach: Workout Log & Tracker app, website at adapt.dubstar.ai, and related services (collectively, "Coach") provided by Brandissimo LLC ("Brandissimo," "we," "us," "our"). By downloading, installing, or using Coach you agree to these Terms and our Privacy Policy.
These Terms supplement the Apple Standard Licensed Application End User License Agreement. Where these Terms and Apple's terms conflict, Apple's terms control.
2. Eligibility
You must be at least 13 years old to use Coach. If you are below the age of majority where you live, a parent or guardian must review these Terms and supervise your use. By using Coach you represent that you meet these age requirements.
3. Fitness information — not medical advice
Coach provides general fitness planning, workout logging, and informational content. It is not medical advice, diagnosis, treatment, rehabilitation, or emergency guidance.
Exercise carries inherent risk. You are solely responsible for:
- Selecting activities appropriate for your current fitness level and health status.
- Using equipment safely and within your abilities.
- Stopping immediately if you experience pain, dizziness, shortness of breath beyond normal exertion, chest discomfort, or other concerning symptoms.
- Seeking qualified medical advice before beginning or significantly changing an exercise programme, especially if you have a pre-existing injury or condition, are pregnant or postpartum, or have concerns about your health.
Body composition information from DEXA scans, Oura Ring data, and Apple Health data that Coach displays are for informational purposes only and do not constitute medical diagnosis or clinical assessment.
4. AI Coach
Coach includes an AI-powered coaching feature powered by Anthropic's Claude technology. AI Coach responses are generated automatically and may be inaccurate, incomplete, or unsuitable for your individual circumstances. You must not rely on AI Coach for medical, emergency, nutritional, legal, or other professional advice. You remain fully responsible for all decisions and actions taken in response to any AI Coach suggestion.
Do not submit sensitive personal information — including medical records, prescription details, financial information, or account passwords — through the AI Coach chat.
5. In-app purchases and subscriptions
Coach may offer optional paid features or subscriptions purchased through Apple's App Store. All purchases are processed by Apple and subject to Apple's payment terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your iPhone Settings → [your name] → Subscriptions. Brandissimo does not issue refunds for App Store purchases; contact Apple for refund requests.
6. Your information and permissions
You are responsible for the accuracy of information you provide and for having the legal right to import any files you submit. Apple Health, iCloud, and Oura Ring integrations require permissions you control and can revoke at any time. Our processing of your information is described in the Privacy Policy.
7. Acceptable use
You may not:
- Reverse engineer, decompile, or disassemble Coach except where expressly permitted by law.
- Attempt to gain unauthorised access to any part of Coach or its related systems.
- Use Coach to violate any applicable law or third-party rights.
- Interfere with or disrupt the operation of Coach or the experience of other users.
- Upload or transmit malicious code or content.
8. Intellectual property
Coach, including its software, design, content, and trademarks, is owned by Brandissimo LLC or its licensors. We grant you a personal, limited, non-exclusive, revocable, non-transferable licence to use Coach on your Apple devices as permitted by these Terms and Apple's applicable licence agreement. No other rights are granted.
9. Third-party services
Coach integrates with Apple HealthKit, Apple iCloud, Oura Ring, and Anthropic's Claude AI service. Your use of those services is governed by their respective terms and privacy policies. Brandissimo is not responsible for the availability, accuracy, or practices of any third-party service.
10. Availability and changes
We may improve, change, suspend, or discontinue features or the entire Coach service at any time. We do not guarantee that Coach will always be available, error-free, or compatible with every device or third-party service. We will endeavour to provide reasonable notice of material discontinuations.
11. Disclaimers and limitation of liability
To the fullest extent permitted by applicable law, Coach is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability.
Brandissimo LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for physical injury arising from activities you choose to perform, to the maximum extent allowed by law. Our total liability to you for any claim arising out of or relating to these Terms or Coach will not exceed the amount you paid for Coach in the twelve months preceding the claim.
Nothing in these Terms removes rights that cannot be waived under applicable consumer protection law.
12. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles, except where applicable local law requires otherwise.
13. Changes and contact
We may update these Terms as Coach evolves. Continued use after the revised effective date constitutes acceptance where permitted by law. We will communicate material changes through the app or this website.
